Bahram Kazimi: Northern beaches cafe owner sentenced for damaging car at Macquarie Centre

A trip to the shopping centre went terribly wrong for a northern beaches cafe owner who exploded in a fit of rage and attacked a stranger’s car after they nabbed his desired parking spot.

A shopping centre car park stand off, which saw a northern beaches cafe owner and aspiring actor smash a car with its windscreen wipers in a fit of rage, has ended in a criminal conviction.

Mona Vale man Bahram Kazimi, 33, was sentenced at Hornsby Local Court on Wednesday after pleading guilty to intentionally or recklessly damaging property.

Documents tendered to court lay out how Kazimi’s April trip to Macquarie Centre, a shopping centre at Macquarie Park, ended with him shattering the windshield of someone else’s car.

After attempting to find a parking spot in Macquarie Centre’s carpark, another person drove into the space Kazimi had found, the court heard.

“(Kazimi) then exited his vehicle and … confronted the victim (stating) … ‘this is my spot, I’ve been going around the parking lot five times’,” court documents state.

According to the police facts, Kazimi became increasingly frustrated when the driver did not respond to him and tore the front windshield wipers off the car before smashing them on the car’s front windshield.

He then walked round to the back of the car, “tore the (rear) wipers off their hinges” and smashed them against the windshield.

“The force of the smash caused the windshield to shatter, leaving a hole approximately the size of a tennis ball,” court documents state.

In court, Kazimi’s defence lawyer said his client owned a cafe in the northern beaches and worked part time as an actor, once performing a role in a Hollywood movie.

The court also heard Kazimi, originally from Afghanistan, came to Australia in 2004 after his father was murdered by the Taliban.

“(Kazimi) has acted completely out of character, and overreacted … he just simply lost it when that occurred,” his lawyer said.

Magistrate Alexander Mijovich told the court he accepted the 33-year-old’s good record and “tragic background”, adding the steps he had taken since migrating to Australia were “quite extraordinary”.

But Mr Mijovich said there was no excuse for acting that way when someone takes a parking spot.

Kazimi was convicted and ordered to pay $700 in compensation.
