A man accused of trying to kill a man with a speargun during an altercation in a northern beaches street will remain behind bars after being refused bail in Manly Local Court on Wednesday.
David Sutherland Tully, 35, of Avalon Beach, is charged with one count of attempt to murder and one count of cause grievous bodily harm.
Police allege Mr Tully shot John Dunne, 48, of Freshwater, with the speargun while the pair were having a verbal confrontation outside a house in North Avalon Rd just before 5pm on Friday.
The spear entered Mr Dunne’s torso just centimetres from his heart.
Mr Dunne, with the 1m spear protruding from the left aside of his chest, managed to enter his car and drive away from the house.
Moments later he pulled the car over in nearby Coonanga Rd and asked members of the public for help.
After being stabilised by a CareFlight rescue helicopter medical team and Ambulance paramedics, Mr Dunne was flown to Royal North Shore Hospital with a section of the spear still in his chest.
He underwent surgery and was released from hospital on Saturday.
Police bail documents tendered to court said Mr Tully had been caring for a man, suffering schizophrenia, for the past 12 months.
The documents also stated that Mr Tully allegedly “verbally intimidated” Mr Dunne.
Magistrate Mark Richardson ordered that a brief of evidence be served on Mr Tully’s Legal Aid solicitor and that he appear again, via audio-video link, in Manly Local Court on October 2.
No plea has been entered.
Mr Tully did not apply for bail and it was formally refused.
