A man waiting to be sentenced on a string of serious charges for the large scale drug supply on the northern beaches has been arrested for breaching his bail conditions — by going to his own birthday party.

Aaron McCauley Waters was supposed to be at his Collaroy Plateau home last Saturday night, but instead he was celebrating turning 28 at a popular Manly waterfront restaurant.

Police heard about the shindig with his family and friends on Thursday and arrested Waters for breaching a strict curfew set as a bail condition.

In court on Friday, Judge Donna Woodburne called his flagrant celebrations at a posh Manly venue “a public display of disregard of orders of the court” and slammed him for wasting police and court resources.

But despite this, Judge Woodburne granted him bail to serve out his final week of freedom before he is likely sentenced to prison on December 3.

Waters, 28, who runs a Dee Why swimming pool business, is facing a lengthy jail term for his involvement in the supply of cocaine and MDMA out of an underground parking garage on East Esplanade, near Manly Wharf.

His lawyer argued Waters needed the final week on bail to make arrangements for his business.

After his arrest in May last year police seized 1381g of powerful party drug MDMA in the garage.

Officers also found more than 90g of cocaine and more than $100,000 in cash.

Police searched Waters’ house on Veterans Parade and found black knuckle dusters and four designer watches including a Rolex, which police suspected were the proceeds of crime.

Waters was set to appear at Manly Local Court on Friday to make a bail application to be released from custody.

Documents tendered to the court alleged that Waters went to the Manly Pavilion restaurant on West Esplanade to “celebrate his birthday”.

“And as such failed to comply with the fourth condition of his bail”.

The District Court had ordered that Waters was only able to leave his home between 6am and 9pm and that was only so he could attend to his Dee Why-based pool cleaning business.

Manly Magistrate Michelle Goodwin said she could not hear Waters’ bail application because his sentencing matter was still before the District Court and that his release had to be decided by the judge hearing the sentencing matter.

A police prosecutor told the court Waters had been allowed “leniency” in his bail conditions to “go about his life and conduct his business” such as visit the gym but the breach was “further evidence of (his) attitude towards orders of the court”.

In granting him bail in the Sydney District Court, Judge Woodburne added a bail condition that requires him to only leave the house with his mother, uncle or stepfather.

Waters is set to appear before the Sydney District Court next week for sentence.
