A driver will fight the accusation that he failed to properly secure a heavy vehicle load leading to a scrap metal spill on a major road in southwest Sydney.

Nelson Faiyaz Hanif Khan fronted Picton Local Court on Wednesday and pleaded not guilty to driving a heavy vehicle not complying with loading requirement substantial risk.

In a police statement released the day after, about 8.10am on June 21, Highway Patrol officers were called to the Camden Bypass at Elderslie after reports of a heavy vehicle losing its load.

“On arrival officers found a prime mover and semi trailer parked on the shoulder of the bypass next to a large amount of scrap metal,” the statement said.

Police will allege Khan loaded the semi trailer, then pulled over after noticing a bulge in the side curtain.

Police allege after the vehicle was stopped, Khan opened the curtain and the load spilled out onto the road and grass verge.

Officers co-ordinated the recovery of the semi-trailer and scrap metal with the assistance of the Traffic Emergency Patrol, Transport Commander and a heavy vehicle recovery company.

Khan was self-represented but notified the court that he was seeking to engage a solicitor. Magistrate Douglass encouraged him to get legal advice due to the hefty fines associated with the charge.

The matter has been set down for hearing in February 2023.
