A man accused of sexually assaulting a woman in Sydney’s southwest will not deny they had sex – but will defend the charges on the issue of consent.

A man accused of sexually assaulting a woman in Sydney’s southwest will not deny they had sex – but will defend the charges on the basis he claims she consented, a court has heard.

Karl Baxter, 35, faced Campbelltown District Court on March 9 for arraignment on charges in respect of an alleged incident on July 14 last year.

Baxter was charged with two counts of sexual intercourse without consent against a woman at an address in the Macarthur region.

The Crown alleges Baxter had sex with the woman twice while knowing she was not consenting to sex.

At his arraignment before Judge Tanya Smith on March 9, the Edmondson Park man pleaded not guilty to both charges.

When Judge Smith asked whether the dispute was as to whether sex had occurred, Baxter’s solicitor confirmed he would defend the charges on the issue of consent.

The trial was set down for five to seven days at Campbelltown District Court on July 31.
