Kane Desmond Gordon: Ingleburn man fronts court over Harper Way public shooting

A man who pleaded guilty to firing a gun in a southwest Sydney public housing neighbourhood will wait to hear his fate. Read what happened in court.

A man who shot a firearm in an Ingleburn street was trying to “scare off” a group of rappers recording a music video on Harper Way.

Kane Desmond Gordon, 42, appeared at Campbelltown District Court on Wednesday after pleading guilty to firing a firearm in a public place with a disregard for the safety of others.

Court documents reveal that on August 15, 2020, a group of Pacific Islanders known as the Ingleburn Boyz rap group was making a music video at the entrance to Harper Way in a public housing neighbourhood.

A resident witnessed Gordon getting out of a car with blood coming from his eyes before he drove off again.

Another video captured by a neighbour, that was played in court on Monday, showed Gordon, wearing a medical tube and lifting his arm straight out holding a gun.

When the camera pans away, a gunshot rings out and when the camera turns back Gordon is still holding his arm straight out.

Another video uploaded to social media captured audio of Gordon yelling “get the f--k out of here”.

Gordon was arrested that night and police conducted a gunshot residue procedure.

During a sentencing hearing on Monday, barrister Sebastian De Brennan said Gordon had a difficult upbringing, which started when he was 12.

He said the circumstances of Gordon’s life was corroborated by independent evidence.

“From a very early age, he is replicating behaviours that he has experienced first hand in the household,” Mr De Brennan said.

“That history of violence was again a feature in 2010 where your Honour will see that he was bashed by two Pacific Islanders and was hospitalised as a consequence of that.

“Again that history is objectively corroborated.”

Mr Dr Brennan said that as a result of Gordon’s life experiences he was “hyper vigilant on this occasion and behaved very irresponsibly”.

“This is a case where that background had a clear nexus to the offence,” he said.

“When I talk about that background, I include not only the history of domestic violence but also the mental health considerations.”

Mr De Brennan said the agreed facts showed he was not close to the rappers at the time and he was just trying to “scare them off”.

“Your Honour will also note that at the time of this incident Mr Gordon’s ability to defend himself was compromised,” he said.

“In the preceding days or weeks he had an ingrown hair that turned nasty … he needed to have a vacuum pump fitted.

“In my submission it was unlikely that someone who is in a vulnerable state of that kind is going to walk up to a big group of Islanders and start a physical fight.”

Mr De Brennan said Gordon has prospects of rehabilitation, as long he accessed the appropriate psychological assistance.

He also noted that there was no evidence submitted from any of the rappers or any reported injuries.

Director of Public Prosecutions representative Marcelo Valerio said the offence was aggravated because Gordon was on conditional liberty.

“[There is] no evidence as to who approached who, what started it, what circumstances,” he said.

“The offender’s reaction is a complete overreaction.”

The matter returns to court on March 25, when Judge Antony Townsden will hand down a sentence.

It is not suggested that the Ingleburn Boyz engaged in any wrongdoing.
