Adam Darwich sentenced after exchanging $25.6k for 112.27 grams of coke found in Louis Vuitton bag

A man who exchanged $25.6k for 112.27 grams of cocaine which police found stashed in a Louis Vuitton backpack has learnt his fate in court.

A man who paid $25.6k for 112.27 grams of cocaine which police found stashed in a Louis Vuitton backpack has been told he will be “paying back to the community” through hundreds of hours of community service work.

Adam Darwich was represented by high-profile lawyer Ahmed Dib as he was sentenced to a two-and-a-half year community correction order at NSW District Court on Friday after Judge Ross Hudson found his offending did not cross the threshold for imprisonment.

The 31-year-old had previously pleaded guilty to greater than indictable drug supply in the local court.

Agreed facts revealed Darwich had parked his Nissan Navara on Liquid Amber Dr, Narellan Vale on August 30, 2022.

A co-accused allegedly pulled up behind the Navara and exited, holding a black backpack and entered the front passenger seat of Darwich’s car before exiting with the same bag.

Strikeforce Raptor police intercepted the co-accused who was allegedly on the way back to his car and found $25,600 cash in the backpack.

Darwich was also arrested by police who located four plastic bags, containing 112.27 grams of cocaine in a Louis Vuitton bag.

Agreed facts indicate Darwich was supplied 112.27 grams of cocaine for the $25,600 and he was taken to Narellan police station.

The crown prosecutor, on Friday, referenced Darwich’s sentencing assessment report where he said his “drug use was escalating” and he was supplying drugs to his friends “free of charge”.

He argued Darwich had been “selling … as opposed to just giving it away”, however, he acknowledged there was nothing in the agreed facts which indicated profit was made.

The prosecutor questioned whether Darwich had suffered from mental health problems and submitted he may have never been affected “at any point in his life” despite accepting his strong subjective background.

He said the offence was “objectively serious” and the threshold for jail had been crossed, which Mr Dib disagreed with, saying it wasn’t a “sophisticated operation”.

Mr Dib said it was “quite clear” Darwich had turned to drugs and his use had developed into a habit as a way of coping.

Judge Hudson had earlier referenced some “context of the offending” which included Darwich being a carer for his father – who was suffering from motor neurone disease – his own ACL injury while also supporting his family

In sentencing Darwich, he found there was “no method to disguise” his offending, there was no evidence of financial gain and his role was “limited”.

Judge Hudson acknowledged there was a drug habit at play, however, he didn’t go as far to declare it an addiction.

He accepted material about Darwich’s tough upbringing and ultimately handed him a 30 month community correction order on top of 200 community service hours.

“You’ll be paying back to the community,” Judge Hudson said.

“Ensure drug use … is not part of your fabric … you’re the one that can ensure history isn’t repeated.”
