Laila Moukhallaletti convicted of concealing serious indictable offence after Heckenberg crash that killed Alina Kauffman, Ernesto Salazar

A young mum, who suggested deleting Instagram photos of a car involved in a horror crash that killed two siblings in Sydney’s southwest, has been slammed as “inhumane” by the grieving family.

A young mother, who suggested deleting Instagram photos of a vehicle involved in a horror crash that killed two siblings just 200m from their home, has been slammed as “inhumane” by the grieving family.

Laila Moukhallaletti, 21, was convicted and sentenced to an 18-month community correction order and 150 hours of community service when she faced Campbelltown Local Court on Friday.

She had earlier pleaded guilty to a charge of concealing a serious indictable offence, stemming from a high-speed collision which killed Alina Kauffman, 24, and her 15-year-old brother, Ernesto Salazar, at Heckenberg in southwest Sydney on September 1 last year.

Moukhallaletti’s friend, Johnson Kokozian, 21, remains behind bars on remand and is yet to enter pleas to 11 charges, including two counts of failing to stop and assist after vehicle impact causing death and two counts of dangerous driving causing death.

Agreed facts in Moukhallaletti’s case state she told Kokozian’s finance, Tiana Savignano, he should delete the photos of the car from Instagram.

“Is he dumb or dumb,” Moukhallaletti texted.

The facts state Kokozian was driving during the fatal collision, with friends Nicholas Romberg, who has not been charged, and Cruz Davis-Tuka as passengers.

The documents say the Mercedes was speeding at more than 100km/h in Heckenberg after Romberg believed he saw an undercover police officer.

Moments later, the car crashed head-on into Alina Kauffman’s Toyota.

The trio removed the sunroof from the car before fleeing the scene and catching a ride with another motorist, asking to be taken to the hospital.

The siblings were pronounced dead at the scene after Ernesto suffered a cardiac arrest and ambulance officers were unable to treat Ms Kauffman, who was trapped in the front seat.

Just over an hour after the crash, the facts say Kokozian, his father Kagadour Kokozian, Romberg, Davis-Tuka and Savignano called triple-0 to report the Mercedes was stolen. Moukhallaletti wasn’t present for the call.

A day after the crash, Moukhallaletti texted Romberg and said he could use her as an alibi and claim they “went out for dinner”.

“(Johnson Kokozian)’s already telling everyone it’s your fault when we all know its not im just trying to be here for you please,” she texted.

The court heard three victim impact statements, including from the siblings’ mother, Angelina Kauffman, who wore a jumper decorated with the faces of her children.

She described the day of the crash as “the day I died inside”.

“How could anyone who knew (about the collision) have had the heart and soul to lie and protect inhumane people?” she said.

“(Ernesto and Ms Kauffman) were the best of friends.

“The love they have for each other is something so special … They were robbed of their lives.

“I pray every night to my babies so I can see and talk to them … My soul is gone, my heart is broken”.

The siblings’ grandmother said “every day for the last 469 days has been a nightmare”.

“Although you’re not the driver, your actions were inhumane,” she told Moukhallaletti.

Moukhallaletti’s lawyer said her client’s remorse was “genuine” and she “regretted her actions” as she was a mother herself.

“There is an appropriate amount of remorse for her actions and (it) has had a significant impact on her mental health,” the lawyer said.

A prosecutor said while the threshold for a jail sentence had not been crossed, the matter was serious “based on the serious indictable offence that was concealed”.

The prosecutor argued if Moukhallaletti was sentenced to a community based order, her mental health would need to be addressed.

Magistrate Greg Elks said there were “certainly no winners in this situation as two young and vital lives have been lost”.

“I have to be careful to not inflate that offence that she has pleaded guilty to,” he said.

“No matter what penalty I impose, it will not be able to improve the situation or pain that is felt by the family of these two young people.”

Moukhallaletti was ordered to report to Community Corrections at Liverpool in the next seven days and continue her mental health treatment.

Kokozian’s father, Ms Savignano and Davis-Tuka have all also been charged with concealing a serious indictable offence and hindering an investigation.

They are yet to enter pleas.
