Danijela Visic: Liverpool woman sentenced for drink driving with children in car

A mum who enjoyed pasta and a lunchtime glass of shiraz before being busted driving more than two times the legal blood alcohol limit – with the two children in the back seat – has been sentenced.

A single mother caught driving more than two times the legal blood alcohol limit – with her two young children in the back seat – told police on her arrest she had only consumed a single glass of shiraz with lunch.

Danijela Visic, 43, pleaded guilty to mid range drink driving after police pulled her over on Memorial Ave, Liverpool at 3.13pm on April 13.

Documents tendered to Liverpool Local Court on Wednesday reveal police found Visic in the driver’s seat of a stationary Hyundai in heavy traffic while looking down at her phone.

“Police have instructed Visic to pull into the car park on the southern kerb, to which Visic had driven past and turned into a common driveway,” the facts state.

At the time of the incident, there was two children under the age of 10 seated in the back.

A roadside breath test returned a positive result of 0.149 and Visic was placed under arrest and taken to Liverpool police station.

“She admitted to consuming one large glass of wine over lunch which consisted of a small amount of bread and pasta,” the facts state.

“She could not recall if she consumed the wine at 1pm or 2pm.”

Visic, from Liverpool, was submitted to breath analysis at the station which returned another positive reading of 0.126.

Visic’s solicitor Gordon Jankov said a conviction might have lasting consequences for the single mother and her actions were unlikely to be repeated.

Magistrate Les Mabbutt convicted Visic, imposed a $8000 fine and handed down a three month disqualification for holding a drivers licence.

“I have considered it all but it’s regrettably the level of the reading and the fact you had two children in the car,” Mr Mabbutt said.

Visic was also ordered to hold an interlock system for 12 months and had her licence surrendered.
