A single mum-of-six kicked a police officer in the groin after they were told to “f**k off’ during a boozy night at her family home in Sydney’s southwest.

A single mum-of-six kicked a police officer in the groin after they were told to “f**k off’ during a boozy night at her family home in Sydney’s southwest.

Atoalii Partsch, 40, was sentenced at Liverpool Local Court on Wednesday after she pleaded guilty to resisting a police officer in the execution of duty, failing or refusing to disclose her identity and assaulting a police officer in execution of duty following an incident at Moorebank on May 29.

Documents tendered to court state police were called to a townhouse after reports of people breaking objects and a man attacking a woman.

When police arrived they found a group including Partsch, a man and other family members and asked if anything had happened.

“The man replied: ‘You’re not welcome here. We didn’t call you so you can f**k off’,” the facts state.

Partsch and the man appeared “highly intoxicated, swaying on their feet with bloodshot eyes and slurred speech” and behaved “belligerently” as they demanded police to leave.

The group continued to deny they knew about the reported incident and refused to provide their details when approached by a police officer.

Partsch and the man were arrested and police escorted them from the home, closely followed by other family members.

“(A family member) approached and told the police not to touch Partsch. Police told him not to approach and to get back but he continued to move in towards police as they attempted to control Partsch,” the facts state.

“The behaviour of the family member escalated, and he continued to approach police closely and said ‘don’t touch me bro, ‘f***ing p***y’.”

“A single burst of capsicum spray was sprayed into his face and the face of another family member who continued to approach closely and demand that police not touch him,” the facts state.

While in handcuffs, Partsch attempted to pull free from police who held her to the ground to control her.

“Partsch kicked (a police officer) in the groin as she attempted to struggle out from under him, causing immediate pain and discomfort,” the facts state.

Magistrate Andrew Miller said Partsch’s assault made the job of police “incredibly difficult”.

“They (police) are not punching bags, they are just doing their job,” he said. “This is another example of a situation that escalates because people fail to comply with their lawful obligations.”

Partsch’s lawyer said while her client’s actions were serious, she reacted after she saw her family member sprayed with pepper spray, which also hit another family member.

Partsch was convicted and was sentenced to a 12-month conditional release order.

No convictions was recorded on charges of resisting a police officer in the execution of duty and failing or refusing to disclose her identity.
