An esteemed Sydney lawyer has fronted court over allegedly speeding at 75km/h in a 40km/h zone.
Shane Neagle, 52, who is a principal solicitor and managing director at Ivy Law Group represented himself at Burwood Local Court over one count of speeding on Monday.
Court attendance notices allege he was exceeding the speed by more than 30km/h at the Westconnex M4 east tunnel about 10.15pm last November.
It further states the alleged offence was caught on camera in Croydon.
Neagle told the magistrate, “I’m representing myself. I’m a solicitor.”
He told the court the speeding offence related to him allegedly travelling 35km/h over in the 40km/h zone.
The Leichhardt father claimed there were 350 offences of motorists targeted by the same camera and he asked to subpoena material of vehicles travelling in about a 15-minute span around the time of the alleged offence.
“Why should they provide that to you?” magistrate Alison Viney said.
Neagle told the court, “They (Transport for NSW) allege a vehicle was ahead of me on the motorway in a lane ahead and I say at the time of the offence the vehicle wasn’t there.”
He also said he wanted to see if the other 350 drivers with offences also protested.
But the magistrate said that material was not relevant to him. “Each is served on their own merits… no magistrate is going to sit through that (…).”
“It is not relevant to you. We don’t compare speeding matters,” the magistrate said.
Neagle further requested material on all work orders to which the Transport for NSW representative said there were none. He also asked for all complaints made in the 13-minute sequence at the time of the alleged offence.
The Transport for NSW lawyer told the court this case was the only one he knew of but said he would check and confirm that.
The magistrate said, “I’m indicating no complaints have been received by Transport for NSW.” Yet she approved for the material to be subpoenaed if that was not the case.
Neagle is the co-founder of Ivy Law Group on Sydney’s York Street specialising in family law and has practised for more than 23 years, according to his work biography.
It further reads, “Shane enjoys spending time being a single parent, and health and fitness.”
Neagle will return to court for his matter on Tuesday.
