An inner west real estate agent has copped a hefty fine and driving ban after he drunkenly crashed his BMW into a guardrail at the entrance of a major Sydney freeway.
Balmain man Deran Osman, 25, faced Downing Centre Local Court on Monday, after pleading guilty to one count driving with a middle range PCA and negligent driving.
A police fact sheet reveals just before 4am on January 19, Osman was behind the wheel of a black BMW, travelling westbound down Gardeners Rd in Mascot.
Upon approaching the overpass leading to the WestConnex M8, Osman lost control of the car and collided with the dividing barrier, agreed facts state.
When police arrived, they found Osman outside of his crashed car telling officers he’d “had a few drinks”, before he was taken to hospital for mandatory testing.
A subsequent result revealed a reading of 0.134, putting him at two and half times over the legal limit.
The court heard Osman was only charged after he “turned himself” into Redfern Police Station nearly a month later on February 16.
On the same day, Osman was given a licence suspension notice.
In a “bold” submission, Osman’s lawyer asked the court to consider a non-conviction, noting his client’s remorse, as outlined in a letter of apology to the court.
“In a letter to the court he has recognised the seriousness of the offending. He is acutely aware,” the lawyer said
The court also heard Osman had completed the traffic offenders program, and his boss along with his colleagues had written letters to the court on his behalf.
However Magistrate Greg Grogin stated the matter “cannot be dealt with without a conviction”, noting Osman’s traffic history included five speeding offences and two mobile phone offences.
Osman was convicted on both counts and ordered to pay a total of $1320 in fines.
His licence was suspended for four 4 months, after which he must enter an interlock program for 12 months.
