A Croydon Park apprentice plumber has been sentenced for a brutal attack on a delivery driver at a house party in Sydney’s north.

An apprentice plumber has been sentenced for attacking a sheesha delivery driver at a house party in Sydney’s north.

A young tradie has successfully had his conviction overturned for punching a delivery driver in the face during an unprovoked and drunken attack, after a court heard about his mental health issues.

Massimo Lombardo, 19, from Croydon Park, fronted the NSW District Court on Tuesday to appeal a conviction he received earlier this year for common assault.

The tradie had been drinking at a house party in North Ryde in July last year when he went outside and confronted a man who was delivering sheesha to the house, according to police facts.

The court heard he punched the driver in the face three times during an “unprovoked” attack.

“The victim pleaded for the accused to stop, asking why he was hitting him,” the agreed facts stated.

Lombardo was dragged away from the victim and police were called. The victim did not suffer any serious injuries.

The court heard this week that Lombardo had been diagnosed with an alcohol disorder, ADHD and intermittent explosive disorder.

Lombardo’s lawyer requested the conviction and criminal charge be dropped on mental health grounds under section 32 of the Mental Health Act.

Judge Dina Yehia said she was not persuaded to deal with the matter under section 32, due to the seriousness of the offence, but rather she resentenced him on the criminal offence.

She accepted his mental health issues had played a part in his offending which reduced his moral culpability.

She resentenced him to a conditional release order without conviction for a period of 18 months, on the condition he continue treatment for his substance abuse.

“The offence was impulsive and spontaneous and there is a link between his mental health issues and substance abuse issues.

“In my view it was his intoxication that led to this conduct.”

Massimo Lombardo, 19, from Croydon Park, fronted Burwood Local Court this week after pleading guilty to one charge of common assault.

The plumber had been drinking at a house party in North Ryde in July when he went outside and confronted a driver who was delivering Sheesha to the house, according to police facts.

He then punched the driver Muhammad Bhatti in his face with both his “left and right fists.”

“The victim pleaded for the accused to stop, asking why he was hitting him,” facts state.

Lombardo was then dragged away as police were called.

When police arrived Lombardo was sitting in the back seat of a car and tried to shut the door “a number of times,” according to facts.

Magistrate Allison Hawkins sentenced Lombardo into a 12-month Community Correction Order.

As part of the order he is to accept treatment in relation to anger management and drugs and alcohol.

He was also fined $750.
