A western Sydney gelato salesman charged with sexually assaulting a woman 17 years his junior after meeting on Tinder is living with his parents, but now wants to find his independence.

Marc Catelli, 37, is facing serious sex crime allegations but is now hoping to move into new digs while out in the community on bail, a court has been told.

Catelli, from Concord, is alleged to have met up with a 20-year-old woman last March after they matched on the dating app.

While at a home in Leichhardt, the woman alleges she was subjected to non-consensual sex act that saw her suffer “actual bodily harm”.

Leichhardt detectives spent six months investigating the case before charging Catelli in October 2020 with aggravated sexual assault.

He and his lawyer fronted Burwood Local Court on Wednesday in a bid to convince Magistrate Greg Grogin that Catelli needed to move out of his parents’ home.

“He is lucky he isn’t bail refused,” Magistrate Grogin said after reading the charges.

Catelli’s lawyer Neil Chow said the 37-year-old has had no breaches on his bail since he was released last November and has no serious criminal offences on his record.

Police investigated the incident for six months before charging Catelli.

“He seeks some independence and to live out of the home now,” he said.

Catelli works in Rydalmere, according to his LinkedIn profile, and was asking for permission to move to an address in Hunters Hill while his sex assault case progresses through the courts.

Magistrate Grogin allowed him to move but refused to reduce the number of days he has to report to Gladesville police station.

Catelli’s case was adjourned to be heard back in the same court on March 31.

His case will eventually have to go up to be heard in the District Court.
