A man has been charged with murder after the alleged victim of an assault in Sydney’s inner west died in hospital, nearly two weeks after being admitted.

A man has been charged with murder after the alleged victim of an assault in Sydney’s inner west died in hospital, nearly two weeks after being admitted.

Emergency services found the 76-year-old alleged victim on Liverpool Rd, in Ashfield, after responding to reports of an assault about 11.45am on September 29.

He was taken to the Royal Prince Alfred Hospital in a critical condition.

Officers from the Burwood Police Area Command established a crime scene and formed Strike Force Parla as part of their investigation, which ultimately led to the arrest of Brian Dutton, 58, about 6.15am last Friday.

Dutton, who was arrested at a shopping mall in Ashfield, was taken to Burwood Police Station, where he was charged with reckless grievous bodily harm and hindering or resisting police in the execution of duty.

He did not apply for bail in Burwood Local Court later that day, when he was remanded in custody.

In a statement on Thursday, police said they had been advised that the injured man had died in hospital that morning.

“The 58-year-old man’s charge has now been upgraded to murder,” police said.

Dutton is due back in court on October 23.
