Morrison was excused from attending court with Ms Newham submitting it was because of his ailing health.

Court documents indicate the two counts of aggravated sexual assault will be withdrawn and police will press four fresh charges connected to the same alleged victim.

The charges include three counts of sexual intercourse with a person under 10 under and aggravated sexual intercourse person between 10 and 14.

An acceptable person has also forfeited a $30,000 bail surety and Morrison is permitted at staying at an address in the Sutherland Shire if he notifies police in advance.

Pleas are yet to be entered with the matter to return to Wollongong Local Court next year.
