Two more men have been charged in relation to an alleged shooting that occurred less than 70 metres from a Dapto primary school late last year.

Michael Black, 32 and Rian Kinloch, 29, were arrested in recent weeks, after Horsley man Derek Ferguson was charged over an alleged daytime shooting on Denham Drive, just metres from Dapto Public School.

Ferguson, 34, was charged with acquiring a firearm while subject to prohibition order, discharge firearm intend cause grievous bodily harm, conceal serious indictable offence, and recklessly deal with proceeds of crime, after he allegedly fired a gun at two men on November 15 last year.

During Ferguson’s first appearance in front of Wollongong Local Court on November 19, police alleged in court documents that two men arrived at his home, and engaged in a short conversation with him, before trying to “rip off” the front screen door. The move allegedly prompted Ferguson to pull out a silver pistol, and fire three shots at the men through the door.

Court documents allege one of the men was hit, before he, and his mate fled. Ferguson allegedly chased the pair, before firing another round of bullets at them.

The two men jumped into a silver Ford Falcon, as Ferguson allegedly fired more shots toward them.

It’s now been revealed that Kinloch and Black have been charged with concealing a serious indictable offence, which carries a maximum prison term of 20 years if convicted.

Kinloch, 29, was arrested just days after the incident on November 22, and charged with conceal serious indictable offence, use prohibited weapon contrary to prohibition order and possess or use a prohibited weapon without permit.

In court documents, police allege Kinloch failed to notify the police that Ferguson had “discharged a firearm with intent to cause grievous bodily harm”.

Kinloch has denied the charges, pleading not guilty to all three offences, and will return to court next week.

Berkeley man Michael Stephen Black was arrested on January 14, and also charged with concealing a serious indictable offence, after not revealing information about Kinloch’s alleged role in the shooting.

Black was released on bail, but taken into custody again on Monday, after failing to report due to an injury to his foot. He was again released on bail to return to court on March 11.

Ferguson will also return to court on the same date.
