A financial manager who was driving and pulled over to masturbate in his car was caught by a bunch of horrified school girls walking by, a court has heard.
Jack Hu, 38, of Roseville appeared at Hornsby Local Court on Wednesday for sentencing after pleading guilty to expose oneself in view from a public school.
According to facts tendered in court documents, the incident happened on Hill St in Roseville when Hu pulled over.
Court documents reveal he was looking at share prices on his phone and then decided to watch pornography so he took off his pants and underwear and began masturbating.
Police note Hu’s car had tinted windows and he had attempted to cover himself with a sunshade on the windscreen and a towel covering the front driver’s window.
However, just before 3.30pm group of school girls were walking towards Roseville Train Station when one of the students saw a man masturbating and “let out a yell”, according to court papers.
Further, documents state a friend of the girl told police she also saw “just sort of skin, but I couldn’t tell what it was” through the passenger window, which was not covered at the time.
The girls continued walking for another few metres when they decided to turn back to check if the man was still masturbating.
The court heard that at this stage he had covered himself up but one of the girls took a picture of the car and told police about the shocking event they had witnessed.
Soon after Hu was arrested by police and he took part in an electronically recorded interview where he admitted to the incident, police state in documents.
Hu told officers he had put a muslin cloth over the passenger seat window but that it “fell because it couldn’t be secured properly” and he “did not notice the school girls”.
During a raid at his home, police found the sunshade and muslin cloth in his car and noted in facts he was “cooperative”.
During court proceedings on Wednesday, Hu’s lawyer explained her client was married and a father to two children under the age of three.
“This is the first time Mr Hue has appeared before a court and as your honour has read from his letter and reference material he is embarrassed and ashamed. It’s the first time he’s been arrested by police. He has made admissions to his conduct,” the lawyer said.
“He is before the court for obscene exposure. In relation to the conduct, it is somewhat difficult to assess objective seriousness because on one hand his actions of masturbating was seen by a 15 year old child but he was in a car.
“His actions were clearly foolish and it should have been done in the privacy of his own home. He decided to pull over and look at pornography. He put a towel over him and it fell. “In that moment he was able to be seen by the public.”
She confirmed he worked as a financial manager and chartered accountant, “working tirelessly to advance his career” and had made a “very grave error”.
“He is understandably concerned about the impact of this on him and his career. He has disclosed it to his wife and to his mother. He’s also been on bail or the past five months.
He’s surrendered his passport. He is unlikely to come before the court again.”
Magistrate Margaret McGlynn said the maximum penalty was six months in jail but “this is nowhere near the worst case scenario”.
“It’s unattractive behaviour sir, it could have been very disturbing for the child that saw it. Given your prior record I’m satisfied today I can exercise discretion.”
He was handed a conditional release order for a period of 18 months and was not convicted.
