A man who sent his ex-girlfriend a video of him urinating on her father’s car, fly kicked her to the ribs when she showed up in a savage attack.
Dylan Bryce Donovan, 19, of Hornsby was sentenced at Hornsby Local Court on Wednesday after he pleaded guilty to contravene prohibition / restriction in AVO (domestic) and common assault.
According to papers tendered in court, police have said “it is evident based on the criminal history of the accused and the matters before the court, that the accused is a remorseless and recidivist offender”.
Police also concluded Donovan poses “an extreme risk to the community” and “holds no regard for the law”.
The brutal attack on his ex partner took place about 10pm on November 2 in South Turramurra at the victim’s family residence.
The victim was sent a video of Donovan urinating on her father’s vehicle parked in the driveway of her home and he’d also thrown food scraps from the victim’s wheelie bin onto her family’s property.
After receiving the footage she decided to catch an Uber home where Donovan was standing outside of a car parked outside her home, where three of his mates were.
The victim took a knife out of her bag and told him to leave, police facts reveal but he refused and she attempted to punch him.
That’s when he fly kicked her to the ribs, “causing instant paint” and continued the assault by “running at the victim, kicking her in the ribs”, police facts state.
He then threw her onto the road, causing the back of her head to hit the surface and she fought back, punching him in the face which caused him to bleed, facts state.
Court documents show during the ordeal Donovan had “spat at the victim multiple times and pushed wheelie bins” into her.
A neighbour called the police and Donovan and his mates fled the scene.
The entire incident was witnessed by the victim’s Uber driver who was interviewed by police. Officers stated they found the victim “visually upset and had blood covered clothing” and suffered an injury to her right wrist, sore ribs and bruising to the back of her head, court papers state.
During Donovan’s sentencing on Wednesday his lawyer John Gooley said his client was aware of the potential consequences but would be willing to comply to “report daily at Hornsby Police”.
“He’s fully employed and works with vision landscapes five days a week. He pays substantial board to his mother and is happy to be subjected to a curfew,” Mr Gooley said.
“He definitely has some problems he isn’t able to identify. I asked him why he would have gone there knowing the conditions in the AVO he said it’s because we love each other and had reached some sort of agreement.
“I think this is the first time he’s had full time employment since he’s left school and he’s a hard worker. I understand reservations of police looking at the paperwork however he does have those factors in his favour.”
Magistrate McManus said she wasn’t impressed by his record.
“It’s extreme offending, in my view it’s at the higher end of common assault given the ongoing nature and the type of assault that it is,” Magistrate Louise McManus said.
“I can’t think of any conditions to make sure he doesn’t reoffend. The defendant doesn’t seem to be able to comply with apprehended violence orders.”
Donovan was sentenced to jail for seven months with a non-parole period of three months. He will be eligible for release on February 3, 2021.
