Teen motorcycle enthusiast charged over death of 41-year-old scooter rider

A western Sydney P-plater has been charged with negligent driving after a fatal scooter crash in Five Dock.

A Kellyville P-plater has been arrested and charged over the death of a 41-year-old scooter rider at Five Dock overnight.

Matthew Giusa, 19, appeared before Burwood Local Court on Wednesday morning, charged with dangerous and negligent driving occasioning death.

Chin Kim Pei, 41, was riding a motorised scooter on William St, Five Dock, at 8.45pm on Tuesday, September 24, when he was allegedly hit and killed by Mr Giusa — who was driving a Toyota Hilux ute — near the intersection of Spencer St.

Bystanders told police at the scene they tried to save the rider, however, the man died at the scene of the incident.

Officers arrested Mr Giusa at the scene, before he was taken in for mandatory testing and charged by the Metropolitan Crash Investigation Unit at Burwood Police Area Command.

Mr Giusa, who appeared before the court in a black T-shirt, glanced towards his family who sat at the back of the courtroom as he entered.

The Hills Shire Times can reveal the 19-year-old attended The John Berne School in Lewisham which deals with children “who have behavioural or emotional problems or who are otherwise at risk of not completing their education.”

During negotiations of a bail application, which prosecutors objected to on the grounds of community safety, Magistrate Stapleton said Mr Giusa had no previous criminal history or criminal association.

“He has very strong community ties, but this is a serious offence,” the magistrate said.

“This is a very sad and serious case but this young man needs legal advice and his liberty to maintain his employment.”

Magistrate Stapleton enforced a nightly curfew, and a weekly report to Castle Hill Police.

“He must surrender his passport within 24-hours of release and is not to sit in the drivers seat of a vehicle,” she said.

Mr Giusa looked down and avoided eye contact with the magistrate throughout the entire proceedings.

He was released on bail and is due to appear before Burwood Local Court on November 20.
