A man involved in a nasty road rage incident in Northmead has escaped conviction after punching another motorist in the face — not long after a bottle of sunscreen lotion was used to escalate the incident.

Emmanuel Miles, 29, from Kingsford, appeared at Parramatta Local Court on Wednesday and was sentenced for common assault.

He pleaded guilty to the charge and was given a conditional release order for six months without conviction.

The magistrate took into consideration his mental health as Mr Miles lives with an intellectual disability.

Mr Miles was driving a Toyota Kluger with his partner and heavily-pregnant stepsister in the car on Wednesday, January 30 along James Ruse Dr.

Police facts stated Mr Miles witnessed a road rage incident in front of him about 7.20pm and he decided to confront the driver of a VW Golf.

He drove alongside the VW before stopping next to the car at an intersection — where Mr Miles and the victim had a heated argument.

Mr Miles’ partner, Samantha Fong, squirted a bottle of sunscreen lotion at the victim’s car after they turned right onto Windsor Rd.

“As the VW had its window down the sunscreen cream landed on the exterior and interior of the car and also on the face of the victim,” police facts stated.

She then threw the bottle of sunscreen lotion at the car which caused a thud sound.

Both vehicles swerved around and overtook each other as the victim signalled Mr Miles to pull over. They were forced to stop because of traffic at a roundabout at the corner of Hammers Rd and Kleins Rd.

Both drivers got out of their vehicles and Mr Miles shoved the victim before punching him in the face. The victim did not strike back.

Police attended and spoke with everyone involved and Mr Miles was later charged with common assault.

The magistrate warned Mr Miles that he was being given another chance on this occasion but that would not be the case if he were to come before the court again.

A conditional release order is essentially a warning which includes a good behaviour period during which time the offender cannot commit any further offences.

Mr Miles has no prior offences involving violence.
