Castle Hill: Conor Lee, Logan Marshall face court after police abused at Church St

Hills youths Logan Marshall and Conor Lee — who were charged after unleashing a barrage of verbal abuse on a cop when he responded to a triple 0 call in Castle Hill — have fronted court for sentencing.

Marshall, 18, and Lee, 19, were charged after verbally abusing Sergeant Barakat Barakat at Church St, Castle Hill, on May 13 at 9.30pm after triple 0 calls raised the alarm about threats to stab someone at Marshall’s home.

Police facts tendered to the court reveal Sgt Barakat was on duty alone when he saw Lee, Marshall and his stepfather Christopher Kirk walking in the middle of the road and was met with a deluge of expletives from Lee – whose mouth was bleeding.

“Before sergeant Barakat could exit the vehicle, Lee was angrily yelling at Sgt Barakat to ‘f*** off’,’’ the facts state.

“He continued to yell these obscenities while walking up to the officer. Sergeant Barakat got out of the police vehicle and by this time Lee was in proximity where he was looking directly at him and yelling f*** off’’.

“Sergeant Barakat could see that Lee was bleeding from the mouth. Lee continued to walk aggressively towards Sgt Barakat while swearing at the officer.’’

Thinking Lee could be armed with a knife, he tried to arrest him but Marshall and Kirk “aggressively’’ approached the policeman, forcing him to release him.

Kirk continued yelling at Sgt Barakat and Marshall yelled at him “You’re a f****n piece of shit.’’

During his arrest, court papers revealed a 17-year-old girl allegedly spat on the policeman’s face, tried to bite his hand and tore his shirt before thrashing out and kicking Constable Jessica Neill.

She was charged with two counts of assault officer in execution of duty and resisting officer in execution of duty.

She was refused bail to appear before a Children’s Court in May 2021.

Lee, Kirk and Marshall were taken into custody after more police arrived.

Court papers said due to Kirk’s demeanour being calm police have discontinued the arrest and informed him he could be dealt with through a court attendance notice.

Lee, a former Gilroy College student from Baulkham Hills, was charged with intimidating a police officer in the execution of duty without causing actual bodily harm.

At Parramatta Local Court on September 2, he pleaded guilty and told the court he was trying to break up a fight on the night he swore at police.

Magistrate Peter Feather asked Lee if he had a drug problem, to which he agreed and apologised for the incident.

“I’m very remorseful for it,’’ the former mechanic said.

He was convicted and fined $800 and received a two-year community correction order.

“You be very careful who you go out with and who you associate with,’’ Mr Feather said.

At Parramatta Local Court on September 9, Marshall pleaded guilty to hindering police/inciting another to assault/resist/hinder police in the execution of duty.

Charges ofintimidating a police officer in the execution of duty, common assault and fail to appear in accordance with bail acknowledgment were dropped.

His lawyer told the court he was not the main protagonist and he was a young man “who got into an unsavoury incident with police”.

“His record is very limited,’’ he said.

Magistrate Stephen Olischlager told the court Marshall’s actions made the volatile situation even worse.

“You were moving towards the police officer despite your requests that you stop going towards him,’’ he said.

Magistrate Olischlager took Marshall’s early plead of guilty and age into account but urged him to grow up.

“You have to understand that you have to start maturing and making better calls in dealing with situations,’’ he said.

“Police officers are entitled to go about their business without your intervention.

“It is time to make better decisions in your life.’’

He imposed a community corrections order for two years without a conviction.
