Safi Al-Hussin charged with murder of Tuan Vo Tran in Mount Pritchard

An Iraqi refugee who was on an ICO when he allegedly murdered Tuan Vo Tran, whose battered corpse was discovered in his Mt Pritchard backyard, has argued he should get bail because he suffers from PTSD and anxiety after coming to Australia.

A second man has been charged with the alleged murder of 35-year-old Tuan Vo Tran, whose battered body was found in the backyard of his Mt Pritchard home in October last year.

Safi Al-Hussin, 43, of Fairfield was refused bail in Parramatta Local Court on Thursday, charged with murder and special aggravated break, enter and commit serious indictable offence.

Mr Tran's battered corpse was discovered at his Young St house on October 30 last year, just before 8am after neighbours reported a disturbance.

While a post mortem examination was inconclusive, police said the 35-year-old had suffered blows to the head and laceration

In court Mr Al-Hussin’s solicitor Upol Amin argued for bail with the condition of full- time house arrest. He arguing his client suffered from post-traumatic stress and anxiety after coming to Australia as a refugee from Iraq.

He said there was not a “single piece of direct or indirect evidence to the scene”.

“One fingerprint is weak for a charge of murder,” he told the court

Mr Amin said his client had strong family and community ties evident with the fact his sister was supporting him in court.

Police prosecutor Charlotte Carter noted that Mr Al-Hussin was currently on intensive corrections orders for other matters “so has the propensity to commit offences whilst on bail”.

Ms Carter said there is CCTV, electronic surveillance, finger and a statement from the co-accused that links Mr Hussin to the crime.

Magistrate Bree Chisholm said while the case was “circumstantial and there is no smoking gun with all circumstantial cases there are a number of things that police relied on to support the Crown case.”

She did not accept that it was a “weak case” but rather there was a “combination of factors”.

She noted there was a fingerprint found at the scene and the accused was allegedly seen with the mobile phone of the deceased a day after murder.

Bail was refused and the matter was adjourned to Penrith court to appear on July 20.

Last week Adam Asad, 39, was arrested at a Cabramatta home and also charged with murder and aggravated break and enter. He was refused bail after appearing in Liverpool court.

Police allege Asad was the driver of a Honda CRV seen arriving at and leaving the Mt Pritchard home at the time of the vicious attack.

His solicitor said his client intended to defend the charges in court.
