Fairfield: Samir Jari charged with damaging property and stalking, intimidation

A pizza shop employee demanded a refund and smashed bricks into an apartment building after visiting an escort who he claimed was a drug addict, a court has heard.

A pizza shop employee demanded a refund and smashed bricks into an apartment building after visiting an escort who he claimed was a drug addict, a court has heard.

Samir Jari, 25, appeared before Fairfield Local Court on Wednesday and pleaded guilty to intentionally damaging property and stalking or intimidation after he attended an apartment in Fairfield East on January 10 for an appointment with a sex worker.

Agreed facts state the escort was staying at an apartment her friend was house sitting and booked an appointment for Jari at 7:30pm.

Once Jari arrived he stayed in the front bedroom for 30 minutes before saying goodbye to the sexworker who advised her friend she would be picked up from the house.

Unbeknown to Jari, the sex worker had left as he returned to the apartment and “banged loudly on the door asking for his money back”.

“Jari walked downstairs and picked up multiple bricks and began throwing them in the direction of a large window in the walkway, causing it to smash,” the facts state.

“He used the brick to bang on the front door of the unit, causing large dents in the wood of the door and further damaged the handle of the door which restricted the door from opening.”

The sex worker’s friend “feared for her safety” and called police who later arrested Jari.

Jari, who was self-represented, told the court he demanded a refund once he “discovered the girl I was with was a drug addict”.

“I am working but not working to give my money to people who take drugs,” he said.

“I was trying to be polite with her and I was asking for my $100 back.”

Jari alleged the escort pushed him out the door and told him to “go away”.

“I felt totally unable to defend myself from a drug addict.”

Magistrate Stuart Devine said Jari took a risk as “sometimes the person you paid money for a service is not what you expect.”

“You’re not entitled to throw bricks through windows because you’re not happy with someone’s business arrangement,” Mr Devine said.

Jari recorded a non-conviction and was sentenced to a conditional release order for 12 months.
