Ali Alyasiry: Smithfield man sentenced for road rage attack

A teenager responsible for a horrific road rage attack, in which he threatened a father of three with a tyre iron and punched him in front of his family, has appeared in court.

The troubled past of a 19-year old who chased down and attacked a father of three in a ‘classic’ road rage attack was ‘no excuse’ for the behaviour, a court has heard.

Ali Alyasiry, of Smithfield, faced charges of intimidation, and assault causing actual bodily harm in Fairfield Local Court today after a horrific road rage attack where he chased down a terrified man driving down Brennan Road, Smithfield, with his wife and kids.

The violent incident took place about 8:30pm on Thursday, March 10.

After an exchange, Alyasiry drove in front of the victim’s car and brake checked him multiple times, before overtaking the family via the wrong side of the road after they tried to escape by changing routes.

When the victim’s car stopped, Alyasiry rushed over and knocked on the window, demanding the driver step out.

The father-of-three got out and attempted to calm Alyasiry down, but was punched instead.

After being hit, he threatened to call the police, and had his phone kicked out of his hand by Alyasiry.

The Smithfield teenager quickly punched his victim twice in the face, and started moving towards the victim’s wife.

When the victim pushed Alyasiry away he went to his car and returned with a tyre iron, pushing it in the victim’s chest while screaming at him, the court heard.

At this point witnesses intervened, pulling the tyre iron from Alyasiry, who then punched the victim again, twice, and slapped him.

The violent attack happened in full view of the victims 12, 10, and one year old children in the car.

Alyasiry’s lawyer argued for him to be dealt with under mental health provisions, rather than criminal, citing untreated trauma in the man’s history, and a past history of domestic violence.

The court heard two years ago, Alyasiry travelled to Iraq as a 17 year old and was kidnapped and held for ransom there.

Alyasiry’s lawyer told the court he had never received treatment after the kidnapping and he was now seeking mental health care for his PTSD.

While Alyasiry alleged the incident was sparked by the victim threatening his mother, his lawyer told the court Alyasiry accepted the perception of a threat may not have been accurate.

“He knows his behaviour was aggressive and unacceptable,” Alyasiry’s lawyer said.

“He is truly sorry to the victims, court, and community for what he has done.”

Magistrate Stuart Devine took the trauma into account, but pointed out a double standard.

“Here you are saying I was exposed to horrendous things as a child, but you are perpetrating the exact same thing to someone else’s children,” Magistrate Devine said.

“You exposed children aged 12, 10 and one to the very thing that you rely on today.”

Alyasiry was already serving a probation order for supplying an indictable quantity of prohibited drugs on an ongoing basis when he committed the offence, the court heard.

Magistrate Devine sentenced Alyasiry on a 12 month community corrections order for both charges, and ordered him to undertake 150 hours of community service.
