Tyreak Shillingsworth-Byers, 20, appeared in Dubbo District Court on Friday to be sentenced for aggravated robbery with wounding, breaking and entering and damaging property.

On September 9, 2022, the 20-year-old tried to gain entry into PoolWorx on Erskine St after 11pm, however the failed attempt activated an alarm.

Turning his attention to Lindsay Mumford Suzuki on the corner of Fitzroy and Erskine streets, he smashed the front glass door to steal to a Suzuki van before starting it up and colliding with another vehicle parked in the car yard.

The business’s CCTV footage tendered to the court showed the 20-year-old driving the van into a gate, where it became stuck - he repeatedly tried to accelerate the vehicle.

The business owner attempted to flee the scene however Shillingsworth-Byers ordered her to give him her car keys before he stabbed in her arm and two separate places on her back with a blade.

Shillingsworth-Byers attempted to steal the car before he was arrested at 11.28pm that night.

His defence stated the offender had “no degree of planning or sophistication” prior to the offence.

Judge Karen Robinson delivered the victim impact statement on behalf of the business owner describing the experience as “terrifying” and “life altering”.

“She reports the incident to have destroyed her sense of safety at home and at work and to have not only affected her personally, but also her loved ones,” Judge Robinson said.

“She strives to feel safe in her own community.”

Judge Robinson acknowledged the offender’s age and said that with his “limited history” before the court he shows remorse for his actions and the victim.

In submissions presented to the court, Judge Robinson also acknowledged his violent and drugged-filled childhood, saying his father was incarcerated on three occasions for domestic violence.

She said the offender is willing to “engage in ongoing treatment” to accept responsibility and continue with his rehabilitation, given the incident was “at odds” with his prior character.

Shillingsworth-Byers is sentenced to a three-year and six-month imprisonment, expiring in March 2026.

He will be eligible for parole September 8, 2024.
