Max Rabbett: Dubbo man pleads not guilty to choking charge

A man has pleaded not guilty to a domestic violence charge after he was accused of choking his ex who allegedly refused to hand back property after a break up.

A 30-year-old Dubbo man has pleaded not guilty to a domestic violence -related choking charge after he was alleged to have lashed out at his former partner following a break up.

Max David Rabbett, the former manager of The Gallery cafe, appeared in Dubbo Local Court to enter his plea and also apply for a property recovery order on Friday.

Court documents state the charge police laid relates to an incident which allegedly occurred on July 11 at a Gipps Street property Mr Rabbett shared with his ex.

When Mr Rabbett went to the property to get some of his belongings his ex allegedly refused to hand over the items.

Police have alleged Mr Rabbett used his left hand to grab his ex around the neck.

Mr Rabbett is further alleged to have put his right hand on his ex’s mouth before he threw him to the ground.

According to police, the incident was allegedly recorded on the ex’s mobile phone.

In court Magistrate Theresa Hamilton made a property recovery order which allows Mr Rabbett to return to the Gipps Street home with a police officer to collect clothing, shoes, personal identity documents and family photos.

The case returns to court in November.
