Luke Withers, Sharon Withers: Dubbo son and mum sentenced after pub ruckus

An ex-prisoner and his mum who caused an epic ruckus after a night out on the grog at a popular pub have faced the music in court.

A violent son and his loving mother have fronted court after a night out ended with a hospital visit and charges laid by police.

Luke James Withers, 33 and his mother Sharon Withers, 52, appeared in Dubbo Local Court for sentencing after their drunken antics on December 13 last year saw them become a focus of a police investigation.

In court documents police said the Withers duo had been enjoying a night out at the Amaroo Hotel when Mrs Withers was asked to leave because she was overly intoxicated.

When an argument started between Mrs Withers and the manager who requested she leave, her son, Mr Withers became concerned.

The manager told him to get out too and they all argued before force was used to remove the Withers duo.

While outside the pub, police said an irate Mr Withers started to violently pull on a door handle and Mrs Withers tried to get back inside the pub.

Neither of them got back in and according to police, Mr Withers threw a punch at a man outside but missed.

When the man tried to fight with Mr Withers the pair were split up, but after hanging around for a short time Mr Withers took off his shirt and tried to start another fight.

Police said while other pub patrons and security guards held Mr Withers back, Mrs Withers unsuccessfully tried to walk over towards the man fighting with her son.

Mrs Withers tripped and fell on her face, while Mr Withers managed to break free from the grip of people holding him back and fought with the man he was out to get.

After their brief altercation ended, Mr Withers took a break and proceeded to sprint down the street towards the man and they punched on again,

Police saw Mr Withers shirtless, with blood pouring out his nose and bruising around his face after the fight ended.

When the conflict had ceased, police said Mrs Withers ended up being taken to hospital because of injuries she sustained after her fall.

Mr Withers pleaded guilty to one count of affray and one count of refusing to leave a venue while intoxicated.

Defence lawyer Anne Hazleton told the court it was “a most unusual matter”.

“Both of them appeared to have had way too much to drink,” she said.

“He served some time in custody in 2015, he came out of that time in custody and managed to effectively rehabilitate himself from the drugs on the basis that he never wanted to go back into custody.

“He is a man that has had some troubles in life … he clearly suffers from an addiction to drugs and alcohol.”

Mrs Withers represented herself and pleaded guilty to failing to leave a premises while being intoxicated.

“I was actually leaving and I noticed the security guard following me around,” she said.

“I walked myself out of the premises.”

Mrs Withers said she was never asked to leave.

“There was an altercation between my son and the security guard.

“All I remember is the security guard picking me up off the ground.”

Magistrate Theresa Hamilton convicted Mrs Withers and fined her $200.

Mr Withers was convicted and placed on a community corrections order for 12 months and fined $200 for failing to leave the pub.
