An intoxicated driver from western NSW has learned his fate after being charged with drink driving for the third time while also having an expired licence.

An intoxicated driver busted drink driving for the third time when he also had an expired licence has learned his fate in court.

Joshua Aaron Jones, 25, faced Wellington Local Court and pleaded guilty to mid-range drink driving in February, 12 days after his licence expired.

Facts tendered to the court state Jones was stopped for a random breath test in Geurie about 12.45am in February.

Jones “began to act in an erratic and aggressive manner towards the police, yelling at police and repeating that he had a ‘very bad day’,” the facts stated.

The offender stated he had “one can of rum”, before initially returning a breath test of 0.157.

Jones was arrested and taken to Dubbo Police Station where he returned a second breath test with a mid-range reading 0.144.

His solicitor David Phillippe said his client “accepts full responsibility”.

However, police prosecutor Sergeant Ben Bragger argued Jones “wasn’t supposed to be on the road at all”.

Magistrate Emma Manea stated she had “no difficulty sending people who drink drive to jail”.

“You’ve lost sight of your responsibility...you had a lack of maturity on this occasion,” she said.

Ms Manea told Jones to imagine something happening to his three children because of a drink driver.

According to the facts, Jones has been found guilty two previous times before the court for low and mid-range drink driving offences.

Jones had also previously “had an interlock device fitted to his vehicle”.

Ms Manea convicted and sentenced Jones to a two year community corrections order with a$1000 fine and disqualified his licence for nine months.

Jones will then be required to hold a mandatory alcohol interlock for two years after he is eligible for his licence.
