Jonathan Cummings appeals sentence for assaulting own father
An elderly Dubbo man was left without teeth and cuts all over his face after his son lashed out because of a broken chair. His son has now appealed his ‘severe’ sentence.

A Dubbo man who bashed his father has launched a bid for a softer sentence after a magistrate handed him a 15-month jail term.
When Jonathan James Cummings, 35, faced Dubbo Local Court on July 15, Magistrate Gary Wilson ordered him to serve the prison term in the community.
Cummings was also banned from drinking alcohol, told to go to counselling and ordered to do 250 hours of community work.
The punishment came after Cummings pleaded guilty to, and was convicted of, one count of assault occasioning actual bodily harm.
According to court documents, Cummings and his father started arguing while they were drinking beer together on December 19 last year.
When his father picked up a chair and smashed it over a table, Cummings lashed out and punched his father in the face repeatedly.
Police arrived on the scene in the early hours of the next morning and found Cummings with no shirt on and blood all over his body.
Cummings’s father was later with found by police with blood stained teeth and cuts to his cheeks, lips and nose.
Police said the injuries the father sustained were so severe he lost some of his teeth.
Arguing the sentence handed down is too severe, Cummings made an appearance in the Dubbo District Court on Monday.
Judge Nanette Williams set October 8 as the date she would hear Cummings’ appeal bid.
