Jason James Elliot: 46-year-old man sentenced for high range drink driving, Dubbo

A Central West fencing manager who was busted three times over the limit has been sentenced for high range drink driving.
Jason James Elliot, of Dubbo, faced Dubbo Local Court on Wednesday admitting to high range drink driving, in the early hours of September 30.
Dubbo Highway Patrol officers stopped the 46-year-old offender in his station wagon on Mitchell Hwy, Dubbo, as police were alerted he was speeding through Wheelers Ln.
An agreed set of facts states detectives, who were occupied with an unrelated matter, witnessed the vehicle travelling at high speeds.
“A strong smell of intoxicating liquor emanated from the vehicle,” the facts stated.
“The accused’s eyes appeared watery and bloodshot.”
After returning a positive roadside reading, Elliot was arrested and taken to Dubbo Police Station, where he returned a reading of 0.1666.
Elliot told police he consumed an “unknown amount of schooners” of Victoria Bitter at South Dubbo Tavern between 6pm and 10pm.
He stated he only consumed a packet of chips in the four-hour period.
According to the facts, Elliot was “deemed to be moderately affected by intoxicating liquor” while speaking with the police.
Self-represented Elliot told Magistrate Gary Wilson obtaining his licence “would be handy for work”.
He told the court he has been in a manager role since September this year.
“Unfortunately, you’ve just slipped into the high range,” Magistrate Wilson said.
The facts stated Elliot was charged with mid-range drink driving and a string of other traffic offences in the 1990s.
“The accused’s criminal history includes domestic violence offences occurred in 2021 and 2022,” the facts stated.
Magistrate Wilson disqualified Elliot from driving for six months, adding an interlock on his vehicle for two years when he receives his licence.
Elliot has also been fined $400.
