Jacob Donn: Wellington crash driver charged with the manslaughter of Shane and Sheldon Shorey to learn fate on October 14
The Wellington crash driver who killed two brothers and injured three others early last year will learn his fate in Dubbo District Court with a judge laying down a date for sentence.
A drugged-up Wellington driver who lost control of a Commodore early last year, leading to a crash that killed two brothers will soon learn his fate.
Jacob Donn, 27, was excused from appearing via video link in Dubbo District Court on Friday as he awaits his sentencing after pleading guilty in the local court for the manslaughter of Shane, 7, and Sheldon Shorey, 6.
He will be sentenced for five charges, including two counts of manslaughter, two counts of aggravated dangerous driving occasioning grievous bodily harm and causing bodily harm by misconduct while driving a motor vehicle.
Four counts of failing to stop and assist after impact causing injury, possessing a prohibited drug and never being a licensed driver will also be considered during sentencing.
Documents tendered to Dubbo Local Court reveal that Donn was seen doing fishtails on Warne Street on January 5 last year when he lost control of his vehicle, colliding with five victims who had been walking along a footpath.
Shayleen Frail, the mother of the two children, attempted to throw her children out of the way, but she did not have enough time.
Documents revealed that Shane and Sheldon were trapped under the vehicle but died at the scene. Another nine-year-old boy sustained severe injuries requiring surgery.
Ms Frail was trapped between the vehicle and the fence, suffering several serious injuries, and an 11-year-old friend of the two brothers required a leg amputation.
Court documents state that Donn apologised to Ms Frail before fleeing from the scene, but police later arrested him at a property in Elizabeth St, Wellington.
Police found 24 buprenorphine strips on Donn. He was taken to Wellington Hospital for drug and urine tests, returning positive results for a combination of drugs, including meth, cannabis, alprazolam, heroin and methadone.
Documents explained that Donn’s driving ability was “substantially impaired” due to the influence of those drugs.
Judge Craig Smith set the sentencing for October 14 and requested both parties to submit their final sentencing material “in advance” so that he could thoroughly read the material.
Donn will appear via video link as he learns his fate.
