‘I will take it out of you’: Dubbo man, 23, convicted after ‘empty’ threat

A Dubbo man who threatened to take his unborn child “out” of a young woman has been sentenced in Dubbo Local Court.
The 23-year-old appeared in court on Wednesday, pleading guilty to one charge of domestic violence related stalk or intimidate intending to cause fear of physical or mental harm.
According to documents tendered in Dubbo Local Court, the man was residing at his family property in Dubbo when he began arguing with the victim in his room on May 31.
During the argument, he told the victim that he didn’t want her to have the baby and that “I will take it out of you”.
The pair then exited the room with his brother – a witness – separating them, before a second witness, his mother, contacted police.
A short time later police arrived to find the victim uncooperative to their questions with each witness unwilling to provide a statement.
The 23-year-old man then exited the house and presented himself to police, admitting that he intimidated the victim by saying that he wanted to take the baby out of her.
He was arrested and taken to Dubbo Police Station.
The court heard from his lawyer, Fiona Alamyar, who conceded that the words used could have caused fear to the victim, however she submitted that it was an “empty” threat.
Ms Alamyar revealed that the victim had threatened her client saying that she would raise the child with another man which in turn made him angry.
She continued her final submission highlighting her client’s limited criminal record as an adult with only one prior incident, and appealing to Magistrate Mal Macpherson for a 25 per cent discount due to an early guilty plea.
Magistrate Macpherson accepted Ms Alamyar’s submissions, convicting the 23-year-old man and placing him on a conditional release order for nine months.
