Dubbo man learns fate in court for having sex with 12-year-old-girl

A convicted rapist who preyed upon his former partner’s 12-year-old daughter has learnt his fate in court after pleading guilty to two counts of sexual intercourse and two counts of sexual touching in 2022.
A 47-year-old man, who cannot be identified for legal reasons, appeared in Dubbo District Court on Friday in his prison greens where he was sentenced to four years and six months imprisonment.
His family appeared in court to support him during his sentencing.
His solicitor Rachel Waugh told the court her client’s desire was “born out of opportunistic lust”.
Documents tendered to the court state the offender preyed upon the victim when they were home alone watching a movie together on the carpet.
He “rubbed” the victim’s vagina over her clothing – she “moved his hand away”.
On a separate occasion when they were home alone again, the offender had his chest “touching her back” and started to move on top of her while biting her breasts on top of her clothing.
In between her “squirming” and pleading for him to stop “she did not have an opportunity to get up”.
In May 2022, the victim and the offender were home alone “wrestling” when he started to bite her ears and breasts.
He proceeded to bite down her abdomen and thighs, moving his way up to her vagina through her pants.
The victim “pulled her pants down” while the offender moved her underwear inserting two fingers into her vagina.
According to the facts, the victim ran to her room and called the police.
The offender called the victim’s mother and said “he had been drinking rum” while confessing his guilt.
Ms Waugh said her client “recognises he needs help” and has “good prospects of rehabilitation”.
Judge Karen Robinson advised the offender that the court took sexual assaults, especially with children, “very seriously”.
While Judge Robinson said “the offender did not take on a fatherly role to the victim” he did “breach trust” with her mother with whom he was in a relationship.
Reading the victim’s impact statement, Judge Robinson said the girl expected “protection from him”.
She acknowledged his “remorse” and “acceptance of responsibility”.
Judge Robinson convicted and sentenced the offender to four years and six months in prison beginning on December 20, 2022. The offender is eligible for parole on September 19, 2025.
