David William Peberdy: Unsuccessful appeal to reduce sentence after head-on crash killing mum and son

A man who was sentenced over a fatal crash which claimed the life of a mother and baby while injuring the lives of two others has tried to appeal the court’s decision. Read the latest here.

A man who was sentenced for the death of a young woman and a baby – while also injuring a toddler and two men – in a head-on crash in the state’s central west has failed in his attempts to appeal a court’s decision.

The NSW Supreme Court dismissed applicant David William Peberdy’s case, which comprises two proposed grounds of appeal, stating Justice Lerace had correctly interpreted the facts and characterised the objective seriousness of the sentencing against the man.

Peberdy’s appeal comes after his sentence imposed in March 2022 following his plea of guilty to two counts on dangerous driving occasioning death and two counts of dangerous driving occasioning grievous bodily harm.

The man received a sentence of five years’ imprisonment, expiring on March 3, 2027, with a non-parole period of three years which will expire on March 3, 2025.

He also received concurrent periods of disqualification from driving of three years for each offence, which will apply from the date he is released.

Holden driver and sole passenger in the car Peberdy was driving a metre onto the incorrect side of the road, causing the Hyundai driver travelling in the opposite direction to veer into his lane.

Peberdy tried to cross back into his lane and collided head-on with the Hyundai - this caused the vehicle to “rotate in a clockwise direction”.

The 25-year-old Hyundai driver and an 11-month-old baby died at the scene.

Her partner, brother and her 2-year-old daughter and the applicant were taken to various hospitals.

Peberdy expressed his remorse and accepted responsibility for the collision, however due to the “extent and nature of the injuries” his sentence was not reduced.
