David Francis Gall: Man has been granted bail after he allegedly killed quad bike rider

A man who is accused of drinking a beer moments after he allegedly killed ‘beloved’ sheep classer Paul Kelly (pictured) has been granted bail.

A man accused of killing a quad bike driver in a crash allegedly drank a beer in disbelief while waiting for the cops has been granted bail, a court has heard.

Warren man David Francis Gall has been granted bail following a bail application review heard in NSW Supreme Court in a Sydney court after being charged with dangerous driving occasioning death.

The 63-year-old appeared via an audiovisual link while in custody at Wellington Correctional Centre for allegedly killing Paul Kelly while drink driving on Gulargambone Rd in Bourbah in May.

The two-vehicle collision occurred between 4.45pm and 5pm on May 19, 58km southwest of Coonamble.

After Gall contacted the police for assistance, he allegedly recorded 0.274 on a roadside breath test.

His solicitor claimed a witness observed Gall consume alcohol after the crash because of his “shock and horror about what’s allegedly occurred”.

He continued saying the witness confirmed Gall was “slurring his words” and had a “strong smell of alcohol”.

Although Justice Julia Lonergan granted Gall bail, she stated he has a “terrible driving record” with a number of offences, including driving while disqualified, driving with a special range of an alcohol reading in August 2022, driving with a low-range in May 2017 and driving with a mid-range in 2002.

“The circumstances of the offending here are said to have involved a collision in a moment of possibly inattentive driving, with a person driving a four-wheeler on a public road,” Justice Lonergan said.

She said the court are still waiting for mandatory blood and urine test results to be confirmed.

Justice Lonergan imposed Gall is to remain abstinent from drugs and alcohol or enter any premises where alcohol is sold.

Gall is ordered to be of good behaviour, to reside in Warren, to comply with a curfew and to report to Warren Police Station three times a week.

He is also ordered to not occupy the driver’s seat of any vehicle, regardless of whether it is turned on or off.

Gall will appear at Dubbo Local Court on September 14.
