A 29-year-old man accused of fatally stabbing another man in the state’s central west has been formally refused bail following an application to the court to be released from custody.
Daniel Fitton, of Campbelltown, denies his involvement which led to the fatal stabbing of 39-year-old George John Kirk on Margaret Cres, Dubbo, on August 16.
Police located Mr Kirk suffering multiple stab wounds to his chest.
He was treated by paramedics but died at the scene.
Police will allege the man was injured after two men entered the home and stabbed him in bed before fleeing.
Strike Force Honefoss was established to investigate the circumstances surrounding the stabbing.
Strike force investigators arrested and charged 39-year-old Mark Peckham with murder earlier this year.
Fitton’s solicitor stated in his client’s bail application, that there is “no evidence” his client had involvement in the murder.
He continued saying Ditton provided his DNA samples to police which did not match samples at the crime scene.
The solicitor claims the alleged offender is accused because Mr Kirk’s partner claimed she saw him in the house during the incident.
Magistrate Gary Wilson stated that “there is nothing more serious than this particular charge you are facing” and dismissed his application.
Fitton was arrested October 17, and taken to Liverpool Police Station where he was charged with murder and a breach of bail after police stopped a Toyota Camry on the Hume Hwy.
Fitton was also fined $500 for unrelated drinking, traffic and weapon charges.
Fitton and Peckham will return to court on February 8, 2024.
