Finlay had been drinking with his partner all night at a hotel in Parkes when he bit her eyebrow, pushed her into a side mirror of a vehicle and choked her.

When the woman pretended she was dead on the ground, Finlay kept picking her up and grabbing her by the hair to pull her back towards him.

Finlay told police he “never should have done it” and the court heard he was a father of two with a limited criminal record.

The court also heard Finlay minimised his offending and a magistrate was left perplexed that Finlay “could blame the victim” for the behaviour he exhibited.

District Court Judge Paul Conlon dismissed Finlay’s sentence appeal, however he changed the 14-month jail term Finlay was handed in the Local Court.

Instead of Finlay serving the time behind bars, judge Conlon ruled Finlay could do his time in the community, by way of an intensive corrections order (ICO).

Extra conditions attached to the ICO include that Finlay must not drink alcohol until December next year and must not associated with his victim.
