A Dubbo bartender who “had a bad night at work” swerved around police while sticking the middle finger up before being hit with multiple driving offences, a court has heard.

Brieanna Finn, 23, appeared in Dubbo Local Court on Wednesday after she was arrested on October 30 and charged with a range of driving offences including low-range drink driving and part of body outside window or door driver.

Other charges included licence expired less than two years before – prior offence, use unregistered registrable class A motor vehicle on road, use uninsured motor vehicle on road and use vehicle on road with tax unpaid.

According to an agreed set of facts tendered to court, on the same day as her arrest, Finn had just finished up working at the Amaroo Hotel when she “swerved around police” on Talbragar St.

It was revealed during this time, Finn “stuck her middle finger up in the direction of police” while taking off at speed, and she was subsequently pulled over.

When questioned by police the 23-year-old was “remorseful and acknowledged her actions were silly”, saying she “had a bad night at work”.

She was then asked to produce her licence with Finn telling police she didn’t have it with her.

However, police checks showed the licence expired on July 31 this year, prompting Finn to say she was in the process of “sorting [it] out”.

Further checks revealed the vehicle’s registration to also be expired as of April 30 and Finn was issued with two infringement notices on August 21 and October 1.

“[Finn] was questioned as to why she had continued to drive the unregistered vehicle while her licence was expired, where she again stated ‘I'm sorting it, I only drive to and from work OK’,” agreed facts reveal.

At this point Finn became “emotional” before returning a positive result to a roadside breath test.

She was arrested and taken to Dubbo police station where she recorded a positive reading of 0.054 to a further breath analysis.

In speaking with police, Finn said she had consumed one vodka Red Bull at the end of her shift at the Amaroo Hotel – approximately 30 minutes before being stopped by officers.

On Wednesday, Finn represented herself telling Magistrate Gary Wilson she “didn’t know” her licence had expired.

The court heard she had finished working at the Amaroo three weeks ago.

Finn was convicted, fined $300 and handed a three month disqualification from driving.
