Brent Waters sentenced for fight with neighbour

A forer Dubbo business owner who spat at a woman, bragged to police about how he was “blind drunk” while driving and threw bottles at neighbour’s property during a bitter dispute.

A former Dubbo chippy who once ran his own business has been convicted of property damage and intimidation offences after a bitter ongoing dispute with his neighbour turned ugly.

Brent Anthony Waters pleaded guilty to charges of driving under the influence of alcohol, reckless driving, property damage and intimidation which occurred on a quite suburban street.

In court documents police said the 32-year-old Dubbo man had been drinking in the garage of his Lincoln Parkway home with a mate when events took a turn for the worst and a neighbour Waters previously worked with, and had been in various disputes with for the past six months, arrived home on March 30.

Waters tapped the neighbour’s driver side window and said “get out of the car c***”.

The neighbour told Waters to go back to his Lincoln Parkway home because he was drunk, however Waters responded by saying “piss off or I’ll smash you now”.

When a woman got out of the neighbour’s vehicle and encouraged him to “smash” Waters, she was spat at by Waters and told to get out of the street because she was a “druggo”.

The neighbour went inside his home with the woman, however Waters started banging the front door.

Another woman who was inside the home told Waters to go home because he was “scaring the kids” and Waters said “I don’t give a f*** about the kids”.

Waters went back to his home and asked his girlfriend to transport the mate he was drinking with back to a hotel.

With a glass Jim Bottle in his hands, Waters got in the front passenger seat of the vehicle and the trio drove off.

Seconds later the girlfriend turned the car around after she saw someone come out of the neighbour’s home and became worried they’d left their house unlocked.

A car came out of the neighbour’s driveway and Waters abused the occupants and smashed a bottle on the road.

After Waters threatened to bash his neighbour, the neighbour threatened to bash Waters’s girlfriend.

The fed-up neighbour picked up a handle that had broken off a sledgehammer and used it to smash the window of the couple’s car which they had returned to and were sitting in at the time.

With glass in his eye and minor injuries, Waters got out of the vehicle and threw his bottle of Jim Beam at the neighbour who was walking home.

The bottle missed the neighbour but left a dent in his garage door.

Waters got back in the car with his girlfriend and said “drive” as the furious neighbour approached them.

After his distressed girlfriend drove to the end of Lincoln Parkway, Waters told her to get in the back seat and started to drive the vehicle while drunk, at excess speeds to Grangewood Drive.

After police arrived, officers said Waters was “antagonistic, hostile and overconfident”.

Waters told police he “gunned it” in the car.

“I was blind drunk … I f****** gunned it out of my street mate,” he said.

On April 12, Waters approached the neighbour’s home again.

According to court documents, he threw a bottle of Great Northern beer at the neighbour’s vehicle and smashed an indicator.

Waters also threatened to bash, kill and stab the neighbour and a woman who was with the neighbour.

“I’ll get you bashed, I’ll have someone here tomorrow,” Waters said to the woman.

In Dubbo Local Court, Waters was supported by his girlfriend as he was sentenced for his crimes.

The court heard Waters previously owned a carpentry business and now worked as a groundsman.

His lawyer said he was diagnosed with a mental illness, which was treated with regular injections.

The court heard Waters identified as Aboriginal, was trying to reconnect with his culture and that his grandmother was a member of the stolen generations.

Magistrate Gary Wilson said it appeared as though Waters instigated the chain of events which landed him in court.

“You were the person who spoke the words,” Magistrate Wilson told Waters in reference to the threats made to the woman.

“These types of threats can’t be made, they cause people considerable concern.

“There’s no doubt it was a very ugly situation.”

Magistrate Wilson accepted Waters made full admissions to police, pleaded guilty early, had been threatened himself and drove only 300 metres recklessly and while under the influence.

For the April 12 property damage and intimidation offences, Waters was convicted and handed community corrections and conditional release orders for 12 months each.

Waters was given conditional release orders and not convicted of driving under the influence of alcohol and driving recklessly.

For damaging the garage door and arming himself with a Jim Beam bottle, Waters was fined $1000.
