A man who threw his ex-partner’s cat down a seven-storey garbage chute has narrowly avoided prison after been convicted of animal cruelty.

Yue Yu, 21, from Chippendale was on Monday fined $6000, put on a two-year community corrections bond and ordered to complete a three-month intensive corrections order after being found guilty of two incidents at Downing Centre Local Court.

Yu, who pleaded guilty to the offences, was also banned from purchasing, acquiring or taking custody of any animal for 10 years.

Magistrate Gary Still told the court on Monday that Yu’s early guilty plea was “the only thing keeping [him] out of jail”.

The court heard ragdoll cat Hibala received serious injuries on two occasions in 2018, resulting in the loss of most of its tail, fractured bones in its front paw, and injuries to its eye, ear and nose.

It heard the apparently jealous Yu threw Hibala down a garbage chute on April 27, 2018, after the cat was left in his care by his former girlfriend.

The cat was found stuck at the bottom of the chute in the apartment block where the couple lived about 7.30pm.

A vet determined it had a fractured tail, open lacerations exposing the bone in his tail, matted and missing fur and severe inflammation around its tail area.

Two thirds of its tail was deemed necrotic and had to be removed to give the cat a chance of survival. It spent four days in hospital before being returned to its owner.

Yu was also convicted over a second incident while his partner was overseas that occurred between June 9 and 23, 2018.

The court heard Hibala’s owner noticed an injury on its nose after requesting a photo from Yu.

She asked Yu to take the cat to a vet but he refused.

The owner’s friend collected the cat and took it for treatment, where a vet found it to have a severe wound with fractured bones in his front left paw, and minor injuries to his eye, ear and nose.

Part of the cat’s foot needed to be removed as it had become severely infected.

Yu was ordered to pay $6000 — $3000 for each incident — and must complete a two-year community corrections order for the first and three-month intensive corrections order for the latter.

Intensive corrections orders are the most serious sentences that can be served without jail time, and are served under the strict supervision of Community Corrections.

Following the sentencing, RSPCA NSW chief executive Scott Meyers called the acts a “shocking display of callousness”.

The cat is now living with its owner in a new apartment away from Yu.
