A furious BMW-driver who violently clocked a 15-year-old private schoolboy on board a school bus in a wild road rage incident has made a last ditch bid to stay out of jail.
Brenton Lowe, 21, has appealed a nine-month jail sentence imposed following his disproportionate response to a “minor collision” involving a hire bus transporting more than 40 students from North Sydney’s Shore school in late 2019.
The Lane Cove crash sparked Lowe to scream and swear abuse at the bus driver however, the situation exploded after a student called him a “dog”.
The Silverwater man, while being filmed by students, got on the bus and yelled “who is a smart-arse c***? … You’re all quiet not, quiet like little b****es’’ before punching a 15-year-old schoolboy in the face. The victim later required dental treatment for damage to two of his teeth.
Downing Centre District Court heard on Monday that Lowe, who has been offered an apprenticeship as a stonemason, had been receiving professional help for anger management issues for more than a year.
The 21-year-old’s barrister called for the jail sentence imposed to be served in the community as an intensive corrections order as a September medical report stated Lowe didn’t present any risk to community safety.
He had pleaded guilty to affray and assault occasioning actual bodily harm.
Judge Dina Yehia adjourned the matter so an updated report from a psychologist could be provided to confirm that the underlying trigger of Lowe’s “appalling, appalling conduct” was being treated.
The matter will return to court in March.
