Wyongah: Dad extradited from Thailand pleads guilty to molesting daughter in the 1990s

A monster who molested his young daughter at Wyongah in the early 1990s before he was extradited from Thailand last year has pleaded guilty.

What happens when you are charged with a crime?

A 64-year-old man has pleaded guilty to five counts of having sexual intercourse with his daughter and one count of committing an act of indecency nearly thirty years after his offending.

The man, who cannot be named for legal reasons, faced Wyong Local Court on Tuesday via video link.

The man replied “yeah guilty” when each of the counts was read out in court relating to the abuse of his biological daughter between 1991 and 1995.

The girl was aged six to 10 when the sexual abuse took place.

An agreed set of facts states the former Telecom worker was living with his wife and two children at Wyongah and he commuted to Sydney every day, which saw him return home late.

In the evenings his daughter would go to bed at 7.30pm and he would come into her room and close the door leaving the room in darkness.

“He would reach out and roll the victim onto her stomach or motion for her to roll onto her stomach and would scratch her back. In time she learnt to roll onto her stomach automatically,” the facts state.

“Over time the offender began sexually abusing the victim, which typically followed the same pattern. The offender would start by scratching the victim’s back and would then remove the victim’s pyjama pants and underwear.”

He would then sexually assault the girl.

“The victim would lie on her stomach with her face buried in her pillow, wishing it would stop, but was too scared to move or say anything,” the facts state.

After a while he would stop and say “goodnight”.

“As she got older, the victim would stay awake at night, waiting for the offender to enter her bedroom,” the facts state.

In 1991 when the girl was in Year 1 at school she underwent a Life Education class where she learnt about “stranger danger” and where people could and could not touch them.

That night after the dad had finished she asked him what sex was.

“The victim felt really uncomfortable, as she knew then that what the offender was doing to her was sexual and wrong,” the facts state.

This went on several nights a week and as she became older she began to resist by kicking the offender and saying “don’t” but not loud enough that her mother would hear.

It continued until she was about 10 years old.

She disclosed to her mum that “dad touched my bum” but her mother said “it’s just his way of showing that he loves you”.

In 2001 the victim disclosed to a friend she had been abused as a child and told another friend she found sexual intimacy with her boyfriend difficult because of what happened to her.

In 2006 when she was studying at Newcastle University she told another friend and later moved to Perth in 2012.

The offender’s relationship with his wife broke down in 2009 and he moved to Coffs before moving to Thailand in 2014, shortly before his daughter reported the offences to Western Australian Police who referred it to NSW Police.

In a series of emails between her mother and father in 2015 her mother asked “what the hell did you really do to her?” and he said he never had sex with her but admitted he “crossed boundaries with her”.

“I knew what I did was wrong because I would drive to work in tears wondering why I would do this knowing and experiencing what had happened to me,” he wrote.

“Inside I was screaming for help, there were no avenues for me that I could see, I wanted to end my life but that would have helped no one.”

Between March 2015 and October 2016 Senior Constable Dominic Marks exchanged emails with the offender asking if he wished to be interviewed in Australia upon his return or in the Australian Embassy in Bangkok.

The man said he didn’t have any plans to return to Australia but would be interviewed at the Embassy.

The interview never eventuated and police commenced extradition proceedings.

On October 28 last year police met Thai authorities at Bangkok International Airport and the man was handed into the custody of NSW Police.

He landed in Sydney on October 30 and agreed to an interview at Silverwater Jail where he denied ever sexually penetrating her but conceded he probably got “over affectionate”.

The man was adjourned to face Gosford District Court on December 16 to set a sentencing date.
