A former competitive bodybuilder claimed he was deeply remorseful when he was caught with nearly 8kg of testosterone and steroids, along with 46 hydroponically grown cannabis plants, at his Wyee home.
But a Crown prosecutor questioned how serious his remorse could be given he told a Community Corrections officer “steroids are socially acceptable” in bodybuilding circles.
Jake Gutter, of Bushells Ridge Rd, Wyee, faced Wyong Local Court on Tuesday, April 4, after pleading guilty to cultivating a prohibited plant and two counts each of supplying and possessing a prohibited drug.
The 31-year-old also pleaded guilty to a further 12 offences, including additional counts of possessing and supplying drugs and having goods in custody, which were included on a form one document and taken into account when he was sentenced.
His solicitor, leading Central Coast criminal lawyer Bobby Locker, told the court his client developed “body dysmorphia” and post traumatic stress disorder from a childhood marred by abuse from an alcoholic relative and sexual molestation at the hands of a woman.
Mr Locker said Gutter developed a drug addiction but had managed to get clean with the help of Narcotics Anonymous for 11 years before the first wave of Covid lockdowns forced meetings online.
Mr Locker said a lot of addicts “relapsed” as a result, including Gutter who began abusing steroids to deal with his body dysmorphia.
An agreed set of facts states police raided Gutter’s address on March 7, 2022, and found
4.7kg of testosterone, 357g of Nandrolone, 609g of Trenbolone, 106.6g of Oxandrolone, 152g of Gamma Butyrolactone, 1kg of testosterone and 805g of Boldenone.
Gutter also retrieved a key and unlocked a room dedicated to the hydroponic cultivation of a total of 46 cannabis plants of varying maturity and more than 800g of cannabis leaf.
“The offender admitted he owned the cannabis and was trying to make `CBD oil’ which ‘might be good for body building’,” the facts state.
“He wasn’t sure how to make the oil and didn’t know when he was going to start.”
Police found the testosterone and other steroids in various bottles and containers throughout the house including the bedroom and kitchen.
“Police found caps and stickers for labelling glass vials and boxes of unused empty vials,” the facts state.
“The offender accepts this testosterone was for the purposes of supply.”
Mr Locker said Gutter was deeply remorseful but the Crown prosecutor questioned Gutter’s remorse given he told a Community Corrections officer who prepared a pre-sentence report that “steroids are socially acceptable” in bodybuilding.
Magistrate Kirralee Perry said Gutter’s early guilty plea demonstrated a degree of remorse and found special circumstances because of his traumatic childhood.
She convicted him of the offences and sentenced him to an intensive corrections order for 20 months with 250 hours of community service and a condition that he abstain from illicit drugs, including steroids, and alcohol.
