Umina Beach: P-plater Joshua MacMillan jailed over drunken crash

A 30-year-old P-plater nearly four times over the legal limit has been jailed after losing control doing a burnout and slamming into another car leaving a man with a broken sternum.

A man who ploughed his unregistered Holden Commodore with false number plates into another car while doing a burnout has been sentenced to jail.

Joshua MacMillan faced Gosford Local Court on Wednesday after pleading guilty to eight offences including high-range drink-driving, assaulting police and dangerous driving.

The court heard MacMillan lost control doing a burnout near the intersection of West and Bullion streets at Umina Beach shortly before 7pm on August 20.

His unregistered and uninsured car went up onto the footpath before slamming into a Toyota Camry, causing it to crash into a nearby shopfront.

A third parked car was also damaged.

The court heard MacMillan was so drunk he had no idea how serious the crash was, telling officers “f..k what have I even done, no one is dead”.

The driver of the Toyota, a 42-year-old man, was treated at the scene before being taken to Gosford Hospital with a broken sternum. His two passengers, aged 18 and 12, were not injured.

MacMillan was assessed at the scene by paramedics before becoming aggressive towards police, pushing an officer before he was arrested.

He was taken to Woy Woy Police Station where he returned a breath analysis reading of 0.180.

The following day he faced court where his Legal Aid solicitor applied for bail, telling the court MacMillan had a “significant gap” since a previous high-range drink-driving offence in 2011.

“He’s had some significant trauma in the last week, his friend had died of a stroke,” she said.

However he was refused bail.

On Wednesday he was sentenced to 15 months jail with a non-parole period of nine months for high range drink-driving, assaulting police and dangerous driving.

The court heard his non-parole period was less than three-quarters of his head sentence because of special circumstances including mental health and drug and alcohol problems.

He was also suspended from driving for three months.

A charge of interfering with a person’s safety was withdrawn and dismissed and no conviction was recorded on charges of unlawfully possessing number plates, not displaying P-plates, using a vehicle with unauthorised number plates and driving an unregistered car.

With time served since his arrest MacMillan will be eligible for parole on May 19, 2021.
