A man had not long finished serving an intensive corrections order (ICO) for drug supply when he did the runner from a service station without paying before allegedly breaking into a motel and assaulting a guest, a court has heard.
Joshua Shane Brown-Vale, of Bateau Bay, faced Wyong Local Court on Thursday after he was arrested and charged with nine offences on Wednesday.
The 29-year-old pleaded guilty to dishonestly obtaining financial advantage by deception when he filled up on 23.43L of unleaded fuel worth $50 from the Shell Coles Express service station at Killarney Vale on May 30 before leaving without paying.
But he pleaded not guilty to driving while suspended on the same day.
Mr Brown-Vale, of Bateau Bay, also pleaded not guilty to breaking into a room at the Sapphire Palms Motel about 11.30am on Wednesday, allegedly damaging the door in the process and two counts of assaulting, including one occasioning actual bodily harm against a guest at the motel.
He also pleaded not guilty to possessing nine tablets of Alprazolam and fireworks when he was arrested by police at the scene but guilty to being in possession of a knife in a public place.
The court heard Mr Brown-Vale had a lengthy criminal history and most recently finished serving an ICO on April 9 for supplying drugs.
However his solicitor, leading Central Coast criminal lawyer Michelle Karim, told the court there was no evidence he stole anything from the motel room.
She said it was largely a “circumstantial case” against Mr Brown-Vale and even if he was convicted of the remaining offences he might receive “an alternative to full-time imprisonment”.
Ms Karim said Mr Brown-Vale operated his own flooring business and could abide by strict bail conditions including that he stay well away from the Sapphire Palms Motel and live with his ex-partner on Cresthaven Ave.
However Magistrate Elizabeth Ellis said Mr Brown-Vale posed an unacceptable risk of committing further offences and refused him bail.
He will face court again via video-link on June 20.
