RESIDENTS will move into the very heart of the Tuggerah Business Park after a developer took Central Coast Council to court and won.

The $18 million proposal to build a six-storey building containing 20 units and an additional 20 serviced apartments, as well as a shop and two food and drink premises, was approved by the Land and Environment Court on April 11.

The development would be built inside the business park on a block of currently vacant land within the Colony Close cul-de-sac.

Developer John Codling first submitted plans to the council in August 2017 and after no decision was reached within a set time period, it was “deemed refused” and Mr Codling made an appeal directly to the court to determine its legality.

Commissioner Joanne Gray heard submissions from the council that outlined why a residential development should not be permitted within the business park.

The council’s solicitors argued the build did not comply with the local planning instruments, was inconsistent with zoning objectives and was ultimately unsuitable for the site.

“I have determined that none of the contentions raised by the council are well founded or warrant refusal of the development application,” she wrote in her final ruling.

The land at 4 Colony Cl was last sold in April 2017 for $1.02 million.
