Mooney: Sonny and Marley Tiopira, Tyson Malcolm enter pleas after beer bottles thrown from car on M1 motorway

Three men pulled over by police after motorists reported beer bottles being thrown from a car on the M1 motorway, two days before Christmas, have entered pleas.

Three men will face court next month after pleading guilty to hindering police when they were pulled over on the M1 motorway following reports of beer bottles being thrown from a moving car.

A common set of agreed facts states police received a number of calls about a silver Holden Cruz swerving between lanes as it travelled north about 3.35pm on December 23 and beer bottles being thrown from the vehicle.

Police were conducting speed checks further north at Ourimbah when they saw the car and activated their lights and sirens to pull the Holden over.

The car stopped on the shoulder of the freeway and the driver Sonny Tiopira, 26, got out and walked around to the back of the car to urinate.

The front seat passenger Marley Tiopira, 28, also got out and proceeded to urinate.

When police approached Sonny, both men immediately became “confrontational” with officers and Marley repeatedly stepped in between them and Sonny, claiming he was the driver.

Sonny continued to walk around the car to avoid police and told officers to “go f..k yourself” when they repeatedly asked him for his licence.

Sonny approached one officer who sprayed him with pepper spray before Marley and a second passenger Tyson William Malcolm, 30, who was in the back seat, tried to prevent police from speaking to Sonny.

After refusing to undergo a roadside breath test, Sonny, who was now hiding in the back seat refusing to come out, spat on one of the officer, hitting him on the arm.

The facts state further police arrived and the trio were arrested and taken to Wyong Police Station where Sonny was charged with driving while disqualified, hindering police, refusing to undergo a breath test or a drug test and assaulting police.

He faced court in January where he pleaded guilty to all of the offences and was adjourned for sentence on March 1.

Marley was charged with hindering and assaulting police.

He later pleaded guilty to hindering but not guilty to assaulting two officers and was adjourned until the same day to set a hearing date.

Malcolm represented himself when he faced court in January but failed to appear when his matter was mentioned briefly on Wednesday, February 15, and he was convicted in his absence.

His matter was also adjourned to March 1 for sentence.

None of the men were ever charged with throwing beer bottles from the car and there is no suggestion they ever did.
