Long Jetty: Troy Webb, 33, headbutted driver in bizarre carjacking attempt while on cocktail of alcohol and cannabis

A man, off his head on alcohol and cannabis, gave a complete stranger a “Liverpool kiss” in a bizarre carjacking but failed to get away because the handbrake was on, a court has heard.

A man will spend six months behind bars after headbutting a stranger during a failed carjacking attempt.

Troy Webb faced Wyong Local Court on Wednesday where he pleaded guilty to common assault, trying to steal a car, driving while disqualified, two counts of hindering police and possessing a small amount of meth.

The court heard the 33-year-old, of Long Jetty, was on an intensive correction order (ICO) and two community correction orders (CCOs) at the time.

An agreed set of facts states a landscaper was dropping his mother-in-law off at her Swadling St address at Long Jetty about 3pm on February 25 when he parked his dual-cab ute and trailer around the corner in Lindsay St.

The facts state Webb approached the trailer and picked up a spray bottle full of poison and began spraying the roadway and lawn.

The victim got out of his vehicle and said words to the effect “what are you doing” to which Webb replied “it’s not yours”.

“The victim grabbed the bottle from the accused. The accused walked to the front of the vehicle and entered the vehicle through the driver’s door shutting and locking the door behind him,” the facts state.

“The victim, fearing his vehicle was about to be stolen, ran to the driver’s door and began banging on the door and window.”

The landscaper saw Webb put the ute in drive and began accelerating harshly but didn’t realise the handbrake was still on.

“The accused exited the vehicle and approached the victim. The accused lashed out headbutting the victim on the bridge of the nose,” the facts state before the pair became involved in a physical fight.

When two police officers arrived Webb resisted their attempts to arrest him before he was overpowered.

He was taken to Wyong police station where he was refused bail and the following day was subject to a strip search which uncovered a small resealable bag containing 0.135g of meth.

The facts state conditions of his existing court orders were that Webb abstain from drugs or alcohol but when police attended his unit they found a “bong” and a bowl of cannabis.

“Police observed the accused to be heavily under the influence of alcohol and believe that he was also under the influence of cannabis at the time of the incident,” the facts state.

His Legal Aid solicitor told the court Webb had a terrible criminal record and was at the crossroads where he would either realise he needed to turn his life around or “die in prison”.

“The court will focus on the hapless dual cab [ute] driver who is set upon for no reason,” the solicitor said.

“[Webb] tried to take the dual cab but the handbrake prevents this and for the owner’s trouble he gets headbutted to the nose.”

Magistrate Trevor Khan said the submission about Webb’s future was “a bit pessimistic” and that generally most long time offenders realised they needed to change “in their mid-40s” so he still had time.

Mr Khan said the circumstances had “the flavour of somebody who is well and truly intoxicated by an illicit substance at the time”.

“The behaviour is not particularly rational in any shape or form,” he said.

“While intoxication is not a mitigating factor it does provide some context.”

Mr Khan said the ute driver was an “absolutely innocent bystander” who copped what used to be called a “Liverpool kiss”.

He sentenced Webb to six months jail, backdated to the day of the incident, and put him on another CCO for 18 months and disqualified him from driving for a further three months.
