Long Jetty: Drunk woman pleads guilty to driving into husband and toddler in 4WD

A woman has pleaded guilty to ploughing her 4WD into her husband and their toddler after a drunken night at the pub, sending the child ‘sliding across the road’, a court has heard.

A husband and wife downed 31 alcoholic drinks between them within three hours before getting into an argument, which ended when she ploughed into him in their 4WD sending the couple’s toddler “sliding across the road”.

The woman, who cannot be named for legal reasons, pleaded guilty in Wyong Local Court this week to assault, assault occasioning actual bodily harm and using a 4WD as an offensive weapon with intent to intimidate.

Upon entering her pleas the police prosecutor successfully lodged a detention application to have the woman taken into custody.

The woman’s solicitor broke down at the bar table during an emotional plea to keep her client out of jail, telling the court the woman had turned her life around, was about to get the child back from community services and now had a “loving relationship” with the toddler.

The woman’s solicitor told the court that since the night on February 21 last year, her client had got a job managing a fast food restaurant and “removing her would have a damaging effect on the child and their relationship”.

However the police prosecutor said not taking her into custody was just “delaying the inevitable”.

An agreed set of facts states the woman and her husband left their toddler in the care of some other children — the eldest being 13 — when they went to Diggers @ The Entrance about 7.30pm.

Club records showed the pair polished off 31 alcoholic drinks between them before she left on her own at 10.30pm.

The facts state she was so blind drunk she couldn’t get her keys in the front door to let herself in and subsequently woke up the children looking after her toddler — and several neighbours — with her swearing and carrying on.

The woman yelled at the teenagers looking after her child and called them “stupid” and “useless” when they couldn’t get the door open and she later assaulted one of them.

“You’re so f’n stupid, how hard is it to get the door open and you can’t even do a simple thing like that,” the woman yelled at them.

The teenage girls said the woman couldn’t talk to them like that “just because you’re drunk” and left the house, calling police as they walked to a nearby service station.

The woman’s husband came home and neighbours could hear them arguing, and their toddler crying, until she jumped in their 4WD and reversed into the man and the child.

One neighbour was on the phone to triple-0 at the time and told the operator” “Oh she’s just f--king run over someone. She just ran over him, f--k”.

Another neighbour also heard a “thud” and the vehicle take off.

Residents came outside and found the husband drifting in and out of consciousness, vomiting and having seizures.

“The vehicle collides with [the husband] knocking him onto the grass verge causing [the child] to go sliding across the road,” the police facts state.

“The white 4WD then mounts the grass verge over [the husband] who crawls to [the child] and picks him up as the offender gets out of her vehicle. The offender takes [the child] from [the husband] and gets back into her vehicle and drives off, leaving [the husband] lying on the ground.”

The woman drove to The Entrance Police Station where paramedics were called to treat the child before the toddler was taken to Gosford Hospital.

Both the woman and her husband were also taken to hospital.

The following day the woman told police she and her husband “were having a great night” and hadn’t argued at all, and instead walked home together.

Police then showed her 11 text messages from her phone to her husband’s phone at 11.04pm where she is swearing and berating him.

She said she couldn’t remember sending the messages, assaulting the teenage babysitter or driving at her husband and their child.

She will face Gosford District Court on April 11 to fix a sentencing date.
